Hi,
Im starting a new DJ site and basically its going to be a online archive of acapellas and instrumentals its a non profit making site and is totally free unless donations come in. The archive i need hosting is about 15 gig would that be a problem for a host to host these files ? ive checked ur written rules examples have been given but nothing is mentioned about acapellas or instrumentals or any kind of media other than pornographic or harmful material, copied software. Ive put so much into this project and need adv b4 taking it any further ? Many thanks Deadsoulja |

Dan is right.
You need to ensure that the content you upload is legal and non-down loadable. You can use http streaming or real streaming to prevent source of your music files.

no other hosting company would allow you to host copyrighted material of others. Best option is to contact the copyright owners and simply ask them if they would allow streaming as most of the Audio / Video companies don't have any problem with Streaming.
Its always good to communicate with the copyright owners as their permission will ensure successful and safe business experience for you ![]()

How long are the clips? Perhaps you could actually set the site up as a torrent site. Create torrents for the clips and initially serve them from your home machine. You should be able to find a host that allows you to have torrent links on your machine as you are not actually storing/serving any copyrighted material.

Ah yes Dan that would be true if the site was owned by you or me. Unfortunately myspace, youtube, etc seem to be able to get away with their sites being full of copyright material. I know they themselves don't directly break any copyright laws, but they own the site so ultimately responsible.

As mentioned DMCA only applies to you and me Dan, otherwise how come sites as these are still online? They are still online because someone like serverbeach couldn't afford to lose their business. Although from today they somehow managed to broker a deal with the Royalties Collection agency. I wonder how much it has cost them?

I'd also point out that the DMCA means nothing if the datacentre is in the UK. You would probably get a cease and desist letter though and a threat of legal action through the British courts.
BTW Youtube has made some effort to remove copyrighted material as a result of the Viacom action but obviously there is still a lot on there. Jon is right in saying that it is Google/Youtube's muscle that is keeping more suits at bay. Even big media companies have to be worried that a really serious attempt to shut Youtube down would result in a hostile takeover bid from Google.

I think they made very little effort though. I think it is fair to say that if you wanted to hear a song, any song, you could find it on either myspace or youtube. Granted a lot are backing tracks to avi's but nonetheless they are all copyright.
Tried to find info today on how much youtube actually are paying the Royalties Commission....I wonder why they won't say?
